North Yorkshire County Council - Notice of Confirmation of a Public Path Diversion Order Highways Act 1980 - Public Footpaths No. 20.44/4, 20.44/5 & 20.1/13, Western House Stables, Melsonby, Diversion Order 2021.
On 22/10/21, North Yorkshire County Council confirmed the above Order made under Section 119 of the Highways Act 1980. The effect of the Order as confirmed is to divert the Public Footpaths described below. Public Footpath 20.44/4 between NZ 2144 0899, & NZ 2016 0853, will be diverted onto a new line between Public Footpath 20.1/8 at NZ 2146 0925 to its junction with the County road at NZ 1992 0907. The footpath between NZ 2146 0925 & NZ 2127 0912 will be re-numbered as Public Footpath 20.1/13. Public Footpath 20.44/5 between NZ 2070 0873 & NZ 2048 0838 will be diverted onto a new line from NZ 2017 0900 to NZ 2016 0853.
A copy of the order as confirmed & the Order Map may be seen free of charge during normal office hours at Richmond Library, North Yorkshire until 24/12/2021. The Order comes into force on the date on which the Authority certifies, in accordance with Section 119(3)(b) of the 1980 Act, that work to the new section of path, described in Part 2 of the Schedule, has been completed, but if a person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under Paragraph 2 of Schedule 2 to the Act as applied by Paragraph 5 of Schedule 6 to the Act, within 6 weeks from 12/11/21, make an application to the High Court.
