A DAD-OF-TWO was spared jail despite failing to complete a community order he was given with a suspended jail sentence.
Daniel Walker was given a six month jail sentence, suspended for 24 months, after taking part in what Teesside Crown Court heard was a “large scale street fight”.
Walker was told to do 140 hours unpaid work in October last year, but to date had only completed 84 and-a-half hours.
Sean Grainger, mitigating, said the 25-year-old, of Gilmore Street, Thornaby, had found a full-time job doing shifts and had also been through a difficult time with his partner’s pregnancy.
He said: “He accepts that he has not complied with the order. He also never got around to supplying the necessary proof that he was in employment [to the probation service].
“He does not want to go to prison and wants to carry on with the order.”
The Recorder of Middlesbrough, Judge Simon Bourne-Arton said he would give Walker a “last chance”.
He ordered that he do a further 60 hours unpaid work and pay £100 court costs within 28 days.
