HEAVY fines left a bad taste in the mouth of Darlington takeaway owners today (Monday, May 12).

Two businessmen ended up before magistrates after routine inspections uncovered filthy conditions and health risks at their premises.

The owners of The Green, in Cockerton, and Simo’s Pizza, on Brignall Moor Crescent, appeared separately at Darlington Magistrates Court charged with a number of hygiene related offences.

Contamination risks and “extremely dirty” conditions greeted environmental health officers who visited The Green in February.

Work surfaces and tiles were covered in grime, drinks were stored close to the toilet and staff members were not suitably dressed or appropriately aware of food safety issues, Yvonne Wood, prosecuting on behalf of Darlington Borough Council, told magistrates.

The shop’s owner, Adam Khalid Ali – of Marwood Crescent, Darlington – pleaded guilty to four contraventions of the Food Safety and Hygiene Regulations Act, including failing to register the business with the council.

Representing himself, he said family problems, including the death of his grandmother, had led to the business becoming neglected.

He said: “Since the inspection, we have turned things around, we have our staff in uniform and a cleaner comes in three times a week.

“I know the shop has been neglected but things have changed and I apologise for how things were.”

Ali, 30, was fined £300 for each offence and ordered to pay costs of £375 and a victim surcharge of £120.

Asad Aria, 39, was also heavily fined after pleading guilty to four contraventions of the same act after inspectors found dirty equipment, a lack of awareness of food safety issues and a lack of management control at Simo’s Pizza.

At the premises, raw hamburger was found stored next to cooked meat, food was not being kept cool while defrosting and hand basins were not in regular use, said Mrs Wood.

Callum Terry, mitigating, said Aria – of Angle Street, Middlesbrough – had since undertaken a course in food hygiene, was extremely sorry and accepted that the conditions had required immediate improvement.

In total, Aria was fined £1,200 and ordered to pay costs of £457.

Councillor Chris McEwan, of Darlington Borough Council, said: “The vast majority of catering premises in Darlington comply with food hygiene legislation and respond positively to advice they are given.

“However, if they fail to meet these standards, the council will take action to protect the health of the public.”

Both premises remain operational.

Why don't they get shut down? They've displayed a complete lack of regard for people's health, it's not like a fine is going to make them develop a conscience.

Everyone should share this article with as many people as they can so these sociopaths go out of business.

Trouble is these businesses get warning, after warning, after warning well before any enforcement action is taken and even then they are still allowed to trade! Their right to make money is put well above public health concerns. Why do our authorities tip toe around those who openly flout the law and show little or no regard for others. It just isnt worth it anymore to be honest, hardworking and play by the rules as those who dont get nothing more than a slap on the wrist.

They'll probably still display there "star rating" like the takeaway on Northgate. They were fined for similar offences (mice droppings if I remember correctly) and still display a star rating in the window!! Think twice is totally correct this should be displayed in their window....not everybody reads the local press!!!

Without a shadow of a doubt there are other establishments in and around the Borough need to be looked at. Dont just fine them shut them down they are playing with peoples lives here, with all the restrictions on food hygiene why is this situation allowed to continue.

I stopped ordering from the Green after getting stomach upsets after eating from there, now I know why. The food quality and service took a dive when they registered onto just eat, as demand increased the quality decreased.

If I had seen the state of the food prep areas I would have never ordered from here as it would have taken some time for that amount of grime to build.

I agree with you fratia, me and her who does the ironing no longer partake in takeaways, filthy shops and halal crap, I make her cook me stuff fresh, like.

I stopped going there years ago after witnessing staff smoking at the front window and looking dirty and unkempt. It was also obvious that they did not wash their hands when they returned to serve a customer. I'm surprised no one has ended up seriously ill.

Yes it would appear that Carole from Darlington never cooks anything herself and orders a meal from there almost on a daily basis and "she" always gives a 6 out of 6 for EVERY meal. There seem to be a few suspect reviews to be honest, but its unfair for me to comment or give them a rating because we never use them- something to be very pleased about. lol. You would thing that Just Eat would have some sort of report suspicious activity form to prevent fraudulent reviews being made by friends or even the owners off such premises, not having that facility makes the whole review and existence of Just Eat rather a waste of time and effort and turns them into just an advertising bollard for eat place. I'm sure Egon Ronay -were he still alive- would have no fears about the competition offered up by Just eat as a food recommending service.

PS i noticed that one of the offenders says he now has a cleaner that comes in 3 times a week. 3 times a week? how many days are they open? surely if they are open 7 days a week they should have a cleaner coming in 7 days a week or once per opening day pro rata.

I was talking to someone just yesterday Saturday 17th and she STILL goes in this place..... My god, do you have to have a death before people stop going in these places of filth? I am with the comment earlier, STOP going in these places once found out, because you can bet your house on the fact they will have at least 6 warnings before any court proceedings took place, STOP going in and close them down ! then and only then will the rest of these outlets will take notice
